Dispute resolution

We tell you early whether a claim is worth pursuing, then take it as far as it needs to go.

Most commercial disputes are decided by documents that existed long before anyone thought there was a dispute.

We give a view on the merits before the costs start, then run the case through negotiation, mediation, arbitration or the courts. Commercial claims go to the Commercial Division of the High Court, and arbitration is governed by the Arbitration Act. The choice between them is usually made in the contract, years earlier.

Where we help

01

Litigation

Commercial claims in the High Court, including the Commercial Division, and in the subordinate courts. We prepare the pleadings and the evidence, and we set out the realistic range of outcomes at the start.

02

Arbitration

Domestic and international arbitration, including drafting the clause, appointing the tribunal, and enforcing or resisting an award. We also advise on whether an existing arbitration clause is workable before you rely on it.

03

Settlement

Negotiated settlement, mediation and without prejudice correspondence, with terms drafted so that the agreement can be enforced if the other side does not perform.

What to expect from us

We tell you how strong your position is, which choices are commercial ones, and the route we would take. A named partner runs the case and reports each time something moves. On a dispute that includes a realistic range of outcomes and what each stage is likely to cost.

Should a dispute go to court or to arbitration?

That is usually decided by the dispute resolution clause in the contract. Where there is a genuine choice, cost, timing, confidentiality and enforceability of the outcome decide it.

It varies with the forum and the number of parties. We give a realistic estimate at the start and revise it when something material changes.

We can agree a fixed fee for a merits opinion or for a defined stage. Contested proceedings are charged stage by stage.
